1. About these terms
These terms and conditions apply to your use of the SOPH website at www.sophnz.com and to every order you place with us. By using this website or placing an order, you agree to these terms. Please read them before you order.
These terms should be read alongside our Privacy Policy and our Cookie Policy, which form part of these terms.
2. Who we are
This website is operated by SOPH MEAL PREP LIMITED trading as SOPH, NZBN 9429053871237, registered in New Zealand at 91 Brookwater Ave, Northwood, Christchurch 8051. In these terms, "we", "us", "our" and "SOPH" mean SOPH MEAL PREP LIMITED. "You" and "your" mean the person using the website or placing an order.

3. Using this website
You may use this website to browse our menu, place orders and manage your account. You agree not to use the website in any way that breaks the law, interferes with its operation, or attempts to gain access to areas or data you have no right to access.
We try to keep the website available at all times. We do not guarantee uninterrupted access and we may suspend, withdraw or change any part of the website without notice.
To place an order you must be at least 18 years old and have the authority to enter into a binding agreement.
4. Our menu
Our menu changes each week. Meals are shown on the website with a description and, where provided, nutritional and allergen information. Menu items are subject to availability and we may substitute an ingredient where supply requires it. Where we substitute a significant ingredient, we will tell you before delivery.
Photographs of meals on the website and on social media are of our own food and are intended to show the dish accurately. Plating and portioning in your container may vary in appearance.
5. Placing an order
When you place an order you are making an offer to buy the meals in your cart at the prices shown. Your order is accepted when we send you an order confirmation email. If we cannot accept your order, for example because an item has sold out or you are outside our delivery area, we will contact you and refund any payment in full.
Please check your order confirmation carefully. If anything is wrong, contact us before the order cutoff time.
6. Order cutoff
Orders for each delivery week close at Wednesday 17:00. Orders placed after the cutoff will be filled in the following delivery week.
Because your meals are cooked fresh to order and ingredients are purchased against confirmed orders, we cannot change, reduce or cancel an order after the cutoff has passed. Requests received before the cutoff will be actioned at no cost.
7. Prices, GST and payment
All prices are shown in New Zealand dollars and are inclusive of GST at 15 percent. DELIVERY FEE STATEMENT: $15 inc. GST per household.
We may change our prices at any time. A price change will not affect an order we have already confirmed. If you have a recurring order, we will give you at least 31 day notice before a price change takes effect, and you may cancel before it applies.
Payment is taken in full at the time you place your order. We accept all credit card providers, Apple Pay, Google Pay & Direct Debit. Card payments are processed by Stripe, and we do not store your full card details. Please see our Privacy Policy for how payment information is handled.
If a payment fails, your order will not be confirmed and your meals will not be produced. We will let you know so you can try again before the cutoff.
8. Recurring orders
If you choose a recurring weekly order, we will charge your saved payment method each week at Monday 12:00 for that week's delivery, until you pause or cancel. We will email you before each charge so you have time to change your meals, pause the week or cancel.
You can pause or cancel a recurring order at any time up to the cutoff, through your account or by emailing us. There is no minimum term, no cancellation fee and no penalty. If you cancel after the cutoff, that week's delivery will still go ahead and be charged, because the food has already been purchased and prepared.
9. Delivery
We deliver to Canterbury area on Saturdays, between 9am - 5pm. You will receive a notification on the day of delivery.
You are responsible for giving us a correct and complete delivery address and any access instructions. If an address is wrong or access instructions are missing and we cannot complete the delivery, we may charge you for the order and for a redelivery.
Your meals are chilled and perishable. If you have asked us to leave your delivery unattended, we will do so at the location you nominate, and responsibility for the food passes to you at that point. We strongly recommend that someone is home, or that you nominate a shaded and secure spot and refrigerate the meals promptly. We cannot accept responsibility for food left unattended for an extended period.
Risk in the meals passes to you on delivery, or on the meals being left at your nominated location.
10. Food safety and storage
Our meals are made fresh and are never frozen. They must be refrigerated on arrival at 4 degrees Celsius or below, and eaten by the use by date shown on the label.
Storage and reheating instructions are printed on each container and included in your first delivery. Please follow them. We cannot be responsible for meals that have been stored or reheated in a way that departs from those instructions, or eaten after the use by date.
11. Allergens and dietary requirements
Allergen information for each meal is shown on the menu and on the container label. Please read it before you order and before you eat.
Our meals are prepared in a kitchen that handles milk, eggs, wheat, gluten, soy, fish, crustaceans, molluscs, tree nuts, peanuts, sesame, sulphites. We take care to avoid cross contamination, and we cannot guarantee that any meal is free from traces of these allergens. If you have a severe allergy or anaphylaxis, please contact us before ordering so we can tell you honestly whether we can serve you safely.
Where you tell us about an allergy, intolerance or dietary requirement, we will use that information to help you choose suitable meals. You remain responsible for checking the ingredient and allergen information for each meal you order. We are not able to prepare a meal that is guaranteed free from a specific allergen unless we have confirmed that with you in writing.
12. Your rights as a consumer
If you are buying as a consumer, the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 give you rights that cannot be excluded. Nothing in these terms limits those rights. Our meals must be of acceptable quality, fit for purpose, and match their description.
If you are buying for the purposes of a business, the parties agree that the Consumer Guarantees Act does not apply, to the extent permitted by section 43 of that Act.
Because our meals are perishable food made to order, they are not returnable and the usual right to change your mind does not apply. Your rights under the Consumer Guarantees Act continue to apply if something is wrong with the food.
13. If something is wrong with your order
If a meal is missing, damaged, or not of acceptable quality, contact us within 24 hours of delivery at orders@sophnz.co.nz with your order number and, where you can, a photograph. We will put it right, which will usually mean a replacement meal, a credit or a refund, depending on what you would prefer and what is practical.
We aim to respond to any issue within one business day.
14. Discount codes, credits and referrals
Discount codes are valid for the period stated, apply to one order per customer unless we say otherwise, cannot be exchanged for cash, and cannot be combined with another offer unless stated.
Account credits have no cash value, apply automatically to your next order, and expire after 365 days.
Referral rewards are issued when the referred customer completes their first paid order. We may withhold a reward where we reasonably believe the referral is not genuine.
15. Reviews and content you send us
If you send us a review, photograph, comment or other content, or tag us on social media, you give us a non exclusive, royalty free licence to use, reproduce and display that content in our marketing, including on this website and on social media, with attribution to your first name or social handle. You can ask us to stop using your content at any time by emailing us, and we will remove it from anything within our control.
You confirm that any content you send us is your own and does not infringe anyone else's rights.
16. Our intellectual property
The SOPH name, logo, recipes, menu descriptions, photographs, website design and written content are owned by us or licensed to us. You may not copy, reproduce or use them commercially without our written permission. You may share our content on social media in the ordinary way, with attribution.
17. Our liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything that cannot be limited under New Zealand law, including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.
Subject to that, our total liability to you for any order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss, including loss of income or loss of opportunity.
18. Events outside our control
We are not liable for a failure or delay caused by something outside our reasonable control, including severe weather, flooding, road closures, power failure, illness affecting our kitchen, supplier failure, or a public health direction. If this happens we will contact you as soon as we can and offer a credit or a refund for any delivery we cannot make.
19. Privacy
We collect and handle personal information in accordance with the Privacy Act 2020. Our Privacy Policy explains what we collect, why we collect it, who we share it with and how you can access or correct it.
20. Changes to these terms
We may update these terms from time to time. The version published on this page at the time you place an order is the version that applies to that order. Where a change materially affects a recurring order, we will email you before it takes effect.
21. Governing law
These terms are governed by New Zealand law, and the New Zealand courts have exclusive jurisdiction over any dispute arising from them.
